Terms of Service

Scope of this document. These Terms of Service apply exclusively to Invictera's mobile applications. They do not govern advisory engagements, consulting services, or other offerings of Invictera LLC, which are subject to separate agreements.

1. Agreement to Terms

By downloading, accessing, or using any Invictera mobile application (the "App"), provided by Invictera LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please delete the App and discontinue use immediately.

2. Educational Use & Trademark Disclaimer

Invictera's applications are algorithmic, supplemental educational tools designed to assist professionals in preparing for certifications and licensure examinations. Invictera LLC does not grant professional certifications or licenses, nor do we guarantee passing scores or specific career outcomes. The content and predictive metrics provided within the Apps are strictly for educational purposes and do not constitute formal legal, engineering, or professional advice.

Invictera LLC is an independent entity and is not affiliated with, endorsed by, or sponsored by the International Association of Privacy Professionals (IAPP), the National Council of Examiners for Engineering and Surveying (NCEES), or any other credentialing or licensing board. All certification titles and acronyms—including but not limited to CIPP, CIPM, CIPT, AIGP, PE, and Professional Engineer—referenced within the Apps are the trademarks of their respective owners and are used solely under nominative fair use.

3. Intellectual Property & Acceptable Use

All original content—including the underlying application architecture, proprietary spaced-repetition algorithms, Bayesian Knowledge Tracing models, and AI-synthesized scenarios—is the exclusive intellectual property of Invictera LLC.

By using the App, you agree that you will not:

Reproduce, redistribute, sell, or publicly display the App's content.
Reverse-engineer, decompile, or attempt to extract the underlying source code, algorithmic engines, or data models.
Use automated systems, bots, or scrapers to extract our proprietary question banks or rationales for use in external datasets, AI training, or competing products.

4. Subscriptions & Apple In-App Purchases

Access to the premium execution engine requires a subscription managed via Apple In-App Purchases.

Trial & Billing: Subscriptions include an introductory free trial. Upon conclusion of the trial, your Apple ID will be charged the selected subscription rate. All billing, cancellations, and refunds are handled exclusively by the Apple App Store. Invictera LLC does not process refunds or manage Apple ID payment methods.
Duration & Renewals: Subscriptions are provided for fixed durations as specified within each application. Unless cancelled via your Apple ID settings at least 24 hours before the end of the current billing period, subscriptions may automatically renew.
Unrestricted Access: A premium subscription grants complete access to all available regional tracks and certification domains for the duration of the active subscription.
No Lifetime Access: Invictera LLC does not offer lifetime access models.

5. Privacy & Data Handling

Your use of the App is also governed by our Privacy Policy, which details our localized, CloudKit-based data synchronization and our strict commitment to zero-PII collection. By using the App, you consent to the data practices outlined in the Privacy Policy.

6. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. INVICTERA LLC DOES NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED OR ERROR-FREE. THE "PREDICTIVE READINESS" SCORE IS A DETERMINISTIC PROBABILITY BASED ON APP ENGAGEMENT, NOT A GUARANTEE OF EXAM OUTCOMES.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INVICTERA LLC, ITS FOUNDERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM YOUR USE OF THE APP, YOUR PERFORMANCE ON ANY PROFESSIONAL CERTIFICATION EXAM, OR ANY CAREER IMPACTS DERIVED FROM THE USE OF THIS SOFTWARE.

8. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
